The trustee program is funded by fees, most of which are paid by companies that file for bankruptcy under Chapter 11 of the Bankruptcy Code, which provides for reorganization. Six districts, however – those in Alabama and North Carolina – are grandfathered into a different system called the Bankruptcy Administrator Program that is overseen directly by the courts.īankruptcy proceedings can often be lengthy and therefore expensive to administer. Most of those districts operate under the United States Trustee Program, housed in the Department of Justice. The United States has 94 districts for bankruptcy proceedings in federal court. This week, we highlight cert petitions that ask the court to consider, among other things, whether the solution is simply to make the fees uniform going forward, or instead to give a refund to debtors who paid higher fees in the past. That decision left open the question of what, if anything, to do about the debtors who had paid the higher fees. Fitzgerald that a 2017 law permitting debtors in bankruptcy proceedings in North Carolina and Alabama to pay lower administrative fees than those paid by debtors in other states violated the Constitution’s requirement that Congress provide uniform bankruptcy laws nationwide. Of that number, only 35 survived and were refloated. Last September, around 200 were beached along the coast of Tasmania, Australia. Toothed whales such as pilot whales that use sonar to navigate are more commonly prone to stranding than their toothless counterparts, Pirotta said.Īnd pilot whale strandings are common across the world. Pilot whales are “very social and dynamic with strong bonds with others,” she said, meaning they could end up getting lost if they followed a disorientated pod member. “It could be that they are trying to avoid a predator, like a killer whale,” she said. Wildlife researcher Vanessa Pirotta said it remains unknown why the pilot whales became stranded, but noted the pod demonstrated the rare behavior of huddling together prior to their beaching. They can be found in waters of the Southern Hemisphere and North Atlantic Ocean.Ī pod of stranded pilot whales off Cheynes Beach in Western Australia. But it was a considerate and well-thought out decision,” he told reporters on Thursday. Incident controler Peter Hartley, from the Department of Biodiversity, Conservation and Attractions, called the decision “one of the hardest” in his 34 years of career in wildlife management. More than 250 volunteers and a team comprising veterinarians and marine life experts joined a rescue mission to try and coax the remaining 45 whales to the ocean.īut the Parks and Wildlife Service of Western Australia said the surviving whales later restranded themselves, with experts concluding that euthanizing them was the best option to “avoid prolonging their suffering”.
